This Privacy Statement sets forth the information gathering, use, and dissemination practices of CIMBS, LLC and/or its affiliates, partners, and assigns, (“CIMBS”) in connection with the World Wide Web site located at www.complexintegrationmbs.com, and any affiliated subpages (“Site”).  This Privacy Statement applies solely to information CIMBS learns about you or obtains from you when you visit CIMBS’s Site.  This Privacy Statement does not address or govern any information gathering, use, or dissemination practices related to information collected in any other way.

This Privacy Statement does not address or govern the collection, maintenance, use, or disclosure of any private health information.  Additional information about your rights with respect to your private health information is available in the HIPAA disclosure statement available at www.complexintegrationmbs.com or directly from CIMBS.

  1. Collection of Personal Information from Site Visitors

CIMBS may collect or track:

  • The home server domain names, e-mail addresses, type of client computer, files downloaded, search engine used, operating system, and type of web browser of visitors to the Site,
  • Your e-mail addresses if you communicate with CIMBS via e-mail,
  • Information you knowingly provide in online forms, registration forms, surveys, e-mail, and other online avenues (including, without limitation, demographic and personal profile data), and
  • Aggregate and user-specific information regarding which pages Site visitors access.

In addition to information you provide, CIMBS may collect the name of the domain and host from which you access the internet; the IP address of the computer you are using; and the browser and operating system you are using; the date and time you accessed the Site; and the internet address of the web site from which you linked to the Site.  CIMBS may place internet “cookies” on visitors’ hard drives.  Internet cookies can save data about individual visitors, such as the visitor’s name, user-name, and the pages of a site viewed by the visitor.  When the visitor revisits the Site, the Site may recognize the visitor by the internet cookie and customize the visitor’s experience accordingly.  Visitors may disable internet cookies, if any, by using the appropriate feature of their web client software, if available.

When a visitor performs a search within the Site, CIMBS may record information identifying the visitor or linking the visitor to the search performed.  CIMBS may also record limited information for every search request and use that information to solve technical problems with the services available directly or indirectly in connection with the Site and to calculate overall usage statistics.

Personal data collected by CIMBS may be used by us for many reasons.  Examples may include, editorial and feedback purposes, for marketing and promotional purposes, for a statistical analysis of users’ behavior, for service development, for content improvement, for fulfillment of a requested transaction or recordkeeping, or to customize the content and layout of the Site.  Aggregate data on visitors’ home servers may be used for internal purposes, and individually identifying information, such as names, postal and e-mail addresses, phone numbers, and other personal information which visitors voluntarily provide to CIMBS may be added to CIMBS’s databases and used for future contact, mailings, and e-mail communications regarding Site updates, news, new services, and upcoming events.

CIMBS may also use Site visitor data to contact the Site visitors regarding account status and changes to the submissions agreement, privacy statement, and any other policies or agreements relevant to Site visitors.

CIMBS will not generally disclose any personally identifiable information to third parties.  Notwithstanding the foregoing, CIMBS may disclose or distribute identifiable or non-identifiable data to a third party under certain situations including:

  • As necessary for the conduct of normal business. For example, CIMBS may disclose your personally identifiable information in connections with bill payment by a third party.

  1. Security Measures

  1. Your Opt-Out Right

You can always choose to withhold any information you do not want to provide, even though the information may be necessary in order for CIMBS provide you with services through the Site.

In addition, except as necessary for CIMBS to provide the services, information, or products requested by you, you may opt out of having your personally identifiable information used by CIMBS for secondary purposes, or disclosed by CIMBS to third parties by contacting CIMBS in writing via postal mail, at the addresses set out above. (This does not apply to collection of the type of web browser of the visitor to the Site or to information provided or collected that does not meet the above description.)  Such a request may result in CIMBS declining to provide services to you through the Site or denying you access to the Site.

Upon your written request via postal mail, CIMBS will provide to you a summary of any personally identifiable information retained by CIMBS regarding you, which information has been voluntarily provided to CIMBS through an account registration, customer order, or electronic news or information subscription.  You may modify, correct, change or update your personally identifiable information by contacting CIMBS in writing via postal mail, at the address above.

  1. Compliance with the Children’s Online Privacy Protection Act (COPPA).

The Site is not directed at children under the age of 13.  CIMBS complies with the Children’s Online Privacy Protection Act (COPPA) and to the extent that CIMBS is able to determine the age of users by their submissions to or communications with the Site, CIMBS will not knowingly collect, use, or disclose personally identifiable information from individuals under the age of thirteen (hereinafter referred to as “Child” or “Children”) without their parent’s or guardian’s consent.  CIMBS does not provide products or services to Children without parental consent.  If you are under 13, you may use the Site only with the involvement of a parent or guardian.

Welcome to www.complexintegrationmbs.com.  CIMBS, LLC and/or its affiliates, partners, and assigns, (“CIMBS”) provides website features to you subject to the following Terms and Conditions (“Terms and Conditions”).  The Terms and Conditions govern your use of the World Wide Web site located at www.complexintegrationmbs.com, and any associated subpages (“Site”).  By accessing, viewing, or using the content, material, or services available on or through this Site, you indicate that you have read and understand these Terms and Conditions, and that you agree to them and intend to be legally bound by them. If you do not agree to these Terms and Conditions, you are not granted permission to use this Site and must exit immediately.

This Site, and its entire content, is offered by CIMBS for informational purposes only, and is in no way intended to constitute medical or psychological treatment of any kind.  Your use of this Site, including for the purpose of communicating with CIMBS, does not create a psychotherapist/client relationship, does not create a physician/patient relationship, nor legal privilege.  You should not act upon any information provided on this Site without first seeking individual professional advice.

CIMBS therapy does not work for everyone.

CIMBS can feel too intimate and/or too intense for some people. The therapist must be careful to titrate the interventions and not bring the patient too far off balance from their usual patterns. Maintaining a healthy therapeutic alliance for the collaborative exploration and experience is of utmost importance. Due to this high level of patient-therapist intimacy, the compatibility of patient and therapist is key to success.

Some of the factors we have observed that impede the learning process necessary to change the patient’s brain are: advance age, brain injury, very low tolerance for anxiety, Border Line Personality Disorders, and Obsessive Compulsive Disorders.

We recommend against using CIMBS with clients/ patients who exhibit active Psychosis, Delirium, or intoxication, have dissociative identity disorders or are in acute psychological crisis or are medically unstable.

CIMBS has not yet been attempted with young children, but older adolescents respond well.

Nothing contained in this informational website should be construed as anything other than material designed to inform the end user about the services that we offer and our methodology. The information presented is not to be relied upon by any person as guidance for an individual situation in the absence of a further in depth discussion with Beatriz Sheldon or Albert Sheldon. Each person’s problems are unique in their own way and not susceptible to solution through material contained on a website.

Typographical Errors

In the event that a CIMBS product is mistakenly listed at an incorrect price, CIMBS reserves the right to refuse or cancel any orders placed for product listed at the incorrect price.  CIMBS reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, CIMBS shall issue a credit to your credit card account in the amount of the incorrect price.

Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages.  If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.

  1. Governing Law, Jurisdiction, and Disputes

By accessing, viewing, or using the works, content, or materials on this Site, you consent to the exclusive jurisdiction of the federal and state courts presiding in King County, Washington, and agree to accept service of process by personal delivery or mail and hereby waive any and all jurisdictional and venue defenses otherwise available.  Any party who unsuccessfully challenges the enforceability of this jurisdiction clause shall reimburse the prevailing party for its attorney’s fees and costs, and the party prevailing in any such dispute shall be awarded its attorneys’ fees and costs.

This Site is controlled and operated by CIMBS from its offices within the United States and the State of Washington.  Without limiting anything else, CIMBS makes no representation that the works, content, materials, services, information, or products available on, in, or through the Site are appropriate or available for use in other locations, and access to them from territories where they are illegal, or otherwise limited, is prohibited.  Those who choose to access this Site from other locations do so of their own free will and are responsible for compliance with all applicable laws.  The waiver or failure of CIMBS to exercise in any respect any right provided hereunder shall not be deemed a waiver of such right in the future or a waiver of any of the other rights established under these Terms and Conditions.

DISPUTES

These Terms and Conditions, including, without limitation, the Privacy Statement, represent the entire agreement between you and CIMBS with respect to the subject matter hereof, and supersede any and all prior and contemporaneous written and oral representations, understandings, and agreements, express and implied, and will be governed by and construed in accordance with the laws of the State of Washington, without regard to principles of conflict of laws.

Notwithstanding the Dispute Resolution provisions below, any dispute relating in any way to your visit to the Site or to products or services sold, distributed, or provided, by CIMBS or through the Site shall be adjudicated in any state or federal court in King County, Washington, and you consent to exclusive jurisdiction and venue in such courts.

Dispute Resolution

In the event any dispute or controversy arising out of or relating to this Agreement, the parties agree to exercise their best efforts to resolve the dispute as soon as possible.  The parties shall, without delay, continue to perform their respective obligations under this Agreement which are not affected by the dispute.

Mediation

In the event that the parties cannot, by exercise of their best efforts, resolve the dispute, they shall submit the dispute to Mediation.  The parties shall, without delay, continue to perform their respective obligations under this Agreement which are not affected by the dispute.  The invoking party shall give to the other party written notice of its decision to do so, including a description of the issues subject to the dispute and a proposed resolution thereof.  Designated representatives of both parties shall attempt to resolve the dispute within 30 days after such notice.  If those designated representatives cannot resolve the dispute, the parties shall meet at a mutually agreeable location and describe the dispute and their respective proposals for resolution to responsible agents of the disputing parties, who shall act in good faith to resolve the dispute. If the dispute is not resolved within 60 days after such meeting, the dispute shall be submitted to binding arbitration in accordance with the Arbitration provision of this Agreement.

Arbitration

Any controversies or disputes arising out of or relating to this Agreement, not resolved through mediation, shall be resolved by binding arbitration in accordance with the then current Commercial Arbitration Rules of the American Arbitration Association.  The parties shall endeavor to select a mutually acceptable arbitrator knowledgeable about issues relating to the subject matter of this Agreement.  In the event the parties are unable to agree to such a selection, each party will select an arbitrator and the arbitrators in turn shall select a third arbitrator.  The arbitration shall take place at a location that is reasonably centrally located between the parties, or otherwise mutually agreed upon by the parties.

All documents, materials, and information in the possession of each party that are in any way relevant to the claim(s) or dispute(s) shall be made available to the other party for review and copying no later than 30 days after the notice of arbitration is served.

The arbitrator(s) shall not have the authority, power, or right to alter, change, amend, modify, add to, or subtract from any provision of this Agreement or to award punitive damages.  The arbitrator shall have the power to issue mandatory orders and restraining orders in connection with the arbitration.  The award rendered by the arbitrator shall be final and binding on the parties, and judgment may be entered thereon in any court having jurisdiction.  The agreement to arbitration shall be specifically enforceable under prevailing arbitration law.  During the continuance of any arbitration proceeding, the parties shall continue to perform their respective obligations under this Agreement.

  1. Force Majeure

CIMBS shall not be liable for any damages resulting from a failure or delay in performance caused by causes beyond CIMBS’s reasonable control and occurring without its fault or negligence, including, without limitation, failure of suppliers, subcontractors, and carriers.  Without limiting anything else in these Terms and Conditions or otherwise, neither CIMBS, its affiliates, contractors, and partners of any and all type, nor all of their respective directors, officers, employees, representatives, proprietors, partners, shareholders, servants, principals, agents, predecessors, successors, assigns, accountants, and attorneys will be liable for any loss resulting from failure of electronic or mechanical equipment or communication lines, telephone or other interconnection problems or errors, computer viruses, unauthorized access, theft, operator errors, severe weather, earthquakes, natural disasters, strikes or other labor problems, wars, armed conflict or governmental restrictions.

  1. Your Account

If you use this Site, you are responsible for maintaining the confidentiality of your private information, for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password, if any.  CIMBS does provide products or services to Children.  If you are under 13, you may use www.complexintegrationmbs.com only with the involvement of a parent or guardian.  CIMBS reserves the right to refuse service, terminate accounts, remove or edit content, cancel orders, or cancel access in its sole discretion.

  1. Risk of Loss

All items purchased from CIMBS are made pursuant to a shipment contract.  This means that the risk of loss and title for such items pass to you upon CIMBS’s delivery to the carrier.

  1. Site Policies, Modifications, and Severability

CIMBS reserves the right to make changes to the Site, policies, and these Terms and Conditions at any time.  If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.  Headings used in these Terms and Conditions are for reference only and shall not affect the interpretation of these Terms and Conditions.

  1. Copyright Complaints

CIMBS respects the intellectual property of others.  If you believe that your work has been copied in a way that constitutes copyright infringement, please provide CIMBS’s copyright agent the written information specified below.  Please note that this procedure is exclusively for notifying CIMBS that your copyrighted material has been infringed.

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
  • A specific description of the copyrighted work that you claim has been infringed upon;
  • A specific description of where the material that you claim is infringing is located on the Site;
  • Your address, telephone number, and e-mail address;
  • A statement by you that you have a good-faith belief that the disputed use is not authorized or allowed by the copyright owner, its agent, or the law;
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
